TERMS AND CONDITIONS

These terms and conditions (the "Terms and Conditions") govern the use of www.foxconstruction.ca (the "Site"). This Site is owned and operated by Fox Construction Services Inc.  This Site is a business website providing information about our construction services. By using this Site, you indicate that you have read and understand these Terms and Conditions and agree to abide by them at all times.

Intellectual Property
All content published and made available on our Site is the property of Fox Construction Services Inc. and the Site's creators. This includes, but is not limited to images, text, logos, documents, downloadable files and anything that contributes to the composition of our Site.

Third Party Goods and Services
Our Site may offer goods and services from third parties. We cannot guarantee the quality or accuracy of goods and services made available by third parties on our Site.

Limitation of Liability
Fox Construction Services Inc. and our directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities and expenses including legal fees from your use of the Site.

Indemnity
Except where prohibited by law, by using this Site you indemnify and hold harmless Fox Construction Services Inc. and our directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities and expenses including legal fees arising out of your use of our Site or your violation of these Terms and Conditions.

Applicable Law
These Terms and Conditions are governed by the laws of the Province of Alberta.

Additional Terms for Clients

• Quotes are provided based on our evaluation at the time of walk-through. It does not include unforeseen price increases, additional costs that may arise due to any government tariffs or taxes that may be implemented after the date of the quote, or additional labor and materials which may be required due to unforeseen issues that may arise.
• Quotes are valid for 15 days. GST extra. Final clean not included unless stated. Construction dust may occur.
• A signed copy of the Quotation must been received prior to commencement of work as stated. If work begins before a signed copy of the Quotation is received, the Client will be deemed to have accepted the Quotation and all associated Terms and Conditions. 
• Payment Terms are upon receipt of invoice, subject to a 2% monthly interest rate. We do not accept credit cards. Payments to be made via Interac e-Transfer, EFT or certified cheque.
•  In the event that emergency work is required to prevent further damage or to restore essential function, Fox Construction Services Inc. may proceed without a signed Quotation. By requesting or permitting such emergency work, the Client agrees to pay all associated costs based on time, materials, and any necessary equipment used. 

Additional Terms for Subcontractors

• No Additional Charges: Subcontractors must not incur or invoice any additional charges without obtaining prior written approval from Fox Construction Services Inc.
• All invoices must be submitted to foxconstructionservicesinc@gmail.com.
  Invoices will be processed only after Fox Construction Services Inc. has received payment from the client.
• Subcontractors are required to maintain valid WCB coverage and provide a current WCB clearance letter for the entire period from the start of work until payment is received.
• Subcontractors must provide clear photo documentation of completed work as part of their submission requirements.
• Any tools, equipment, or materials belonging to the subcontractor that remain on site 30 days after completion of work will be deemed abandoned property. Fox Construction Services Inc. reserves the right to remove, store, or dispose of abandoned items at its sole discretion, without compensation to the subcontractor. Fox Construction Services Inc. assumes no responsibility for loss, damage, or disposal of any items left on site beyond the 30‑day period.

​Severability
​If at any time any of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid.

Changes
These Terms and Conditions may be amended from time to time in order to maintain compliance with the law and to reflect any changes to the way we operate our Site and the way we expect users to behave on our Site. We will indicate on our website when these Terms and Conditions have been updated.
